1. Agreement to Terms

These Terms and Conditions ("Terms") govern all orders, services, and transactions between PrintABook Pty Ltd (ABN to be inserted) ("PrintABook", "we", "us", or "our") and you ("Customer", "you"). By submitting an order or inquiry through our website printabook.com.au, or by otherwise engaging our services, you agree to be bound by these Terms.

We reserve the right to update these Terms at any time. The version published on our website at the time you place your order applies to that order.

2. Services

PrintABook provides professional book printing and binding services, including but not limited to:

We operate from Sydney, NSW, Australia and ship to addresses throughout Australia. All services are subject to these Terms.

3. Orders & Payment

3.1 Order Acceptance

An order is not accepted until we confirm acceptance in writing (via email). Submitting a quote request or order form does not constitute a binding contract until confirmed by us. We reserve the right to decline any order at our discretion.

3.2 Pricing & Quotes

All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Quotes are valid for 30 days from the date of issue. Prices may be subject to change if your specifications change after the quote is issued, or if production costs change materially.

3.3 Payment

For offset hardcover book orders, a deposit (typically 50%) is required upon order confirmation, with the balance due prior to shipment. For digital photobook orders, full payment is required before production commences. Payment links will be issued via email. We accept payment by credit card, debit card, and bank transfer. Production will not begin until cleared payment is received.

3.4 GST

All prices include Goods and Services Tax (GST) where applicable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Tax invoices will be provided upon request.

4. File Requirements & Customer Responsibility

You are responsible for supplying print-ready files that meet our technical specifications. Our general requirements include:

We will review your files prior to charging final payment and will notify you of any significant issues. However, you remain solely responsible for the accuracy and legality of your content, including proofreading, copyright clearance, and colour accuracy on screen vs. print. Printed colours may vary slightly from on-screen representations. We will not be liable for errors in customer-supplied content approved for print.

5. Production & Turnaround

Production commences once cleared payment is received and files are approved. Indicative lead times are:

Lead times are estimates only and not guaranteed. Delays may result from factors beyond our control including printing press scheduling, materials supply, or logistics. We will keep you informed of any material delays. Rush production may be available subject to availability and additional charges.

6. Shipping & Delivery

We ship to addresses throughout Australia via reputable carriers. Shipping costs will be provided at the time of quoting or invoicing. Estimated delivery times are indicative only and we are not liable for delays caused by carriers.

Risk of loss passes to you upon handover of the goods to the carrier. We recommend retaining tracking information. If goods are damaged in transit, you must notify both the carrier and us within 5 business days of receipt and retain all original packaging for inspection.

For offset print orders shipped from overseas print facilities, balance payment is due prior to release of goods for international freight.

7. Cancellations & Refunds

7.1 Cancellations

You may cancel an order prior to production commencing. Any deposit paid may be retained by us to cover work already performed (file review, pre-press, administration). Once production has commenced, cancellations are not accepted and the full order value is payable.

7.2 Defective Products

If your order contains a manufacturing defect or material deviation from approved specifications, please notify us within 10 business days of receiving your order with photographic evidence. At our discretion, we will arrange a reprint or issue a credit. We do not offer refunds for customer errors in supplied files that were approved for print.

7.3 Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts, or modifies any right or remedy to which you are entitled under the Australian Consumer Law.

8. Intellectual Property

You warrant that you own or hold all necessary rights, licences, and clearances for all content, images, text, and other material you supply to us for printing. You grant PrintABook a non-exclusive, royalty-free licence to reproduce and produce your content solely for the purpose of fulfilling your order.

PrintABook retains all intellectual property rights in its website, brand, templates, and processes. You must not reproduce our materials without written permission.

You indemnify PrintABook against any claim, loss, or damage arising from any third-party intellectual property infringement in content you supply.

9. Limitation of Liability

To the extent permitted by law, PrintABook's total liability to you for any claim arising out of or in connection with these Terms or your order (whether in contract, tort, or otherwise) is limited to the amount paid by you for the specific order giving rise to the claim.

To the extent permitted by applicable law, we exclude all liability for indirect, consequential, incidental, or special loss or damage (including loss of profits, business, revenue, or anticipated savings).

Nothing in these Terms limits our liability for personal injury or death caused by negligence, fraud, or any liability that cannot be lawfully excluded under the Australian Consumer Law or other applicable legislation.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.
